'Problems of the Transnational Access to Electronic Evidence in the Light of European Mutual Legal Assistance in Criminal Matters': Starting from the status quo of the European mutual legal assistance in criminal matters, the work analyses the problems of the transnational access to electronic evidence. Taking the US CLOUD Act into consideration, the limits of the principle of mutual recognition under EU law and the admissibility of supranational legislation in the context of cross-border criminal investigations are analysed. The drafts and the adopted e-evidence regulation are subjected to a critical examination.

Luca Petersen studierte Rechtswissenschaften an der Georg-August-Universität in Göttingen und der University of Galway, Irland. Nachdem er 2020 das erste Staatsexamen mit einem Schwerpunkt im internationalen und europäischen (Straf-)Recht abschloss, promovierte er am Lehrstuhl von Prof. Dr. Dr. h.c. Kai Ambos. Es folgten Beschäftigungen in Wirtschaftskanzleien und Lehraufträge an der Universität Hamburg. Das Referendariat absolvierte Luca Petersen am Oberlandesgericht Hamburg mit Stationen unter anderem in London. Mit Abschluss des zweiten Staatsexamens begann er als Rechtsanwalt auf dem Gebiet des Wirtschaftsstrafrechts und arbeitet für die Kanzlei EVEN Rechtsanwälte in Hamburg.
