'Objective Imputation: Act or Object of Judgment? From the Ambiguity of Objective Imputation to the Revision of the Concept of Imputation': The 'objective imputation' in criminal law has a hybrid form: On the one hand, it functions as a feature of the offense (object of judgment), on the other hand as a normative judgment (act of judgement). The study explains this logical ambiguity in terms of conceptual history. It then discusses it on the basis of the requirement of intent in the most recent case law of the Federal Court of Justice (4 StR 200/21). It concludes with some theses on a revision of the concept of imputation.
Autorenportrait
Martin Heuser studied law at the University of Bonn on a scholarship granted by the state of North Rhine Westphalia. Subsequently he worked as a research assistant at a chair of Criminal Law and Legal Philosophy at the University of Regensburg. In 2019 he earned his doctoral degree at the University of Bonn. The second state law examination followed in 2020. In 2023, he was interim professor at the Leipzig Faculty of Law, in 2024 at the University of Konstanz.
