'A Comparative Study on 'Verkehrspflicht' in Chinese and German Tort Law, with Particular Regard to the Misconduct of the Injured or a Third Party' This thesis aims to the key questions of tort law against the background of the compilation of the Chinese Civil Code. Three main questions are answered by a functional comparison between Chinese and German civil law: firstly, the function of the concept 'Illegality' in the structure of tort liability; secondly, the duty of safety protection to the unauthorized persons; thirdly, the liability for compensation in the case of infringements caused by a third party.
