'The Judicial Development of the Law in Germany and Switzerland' The thesis deals with judicial development of the law in the case of legal gaps. It analyzes twenty mainly civil law decisions each of the German Federal Court of Justice (BGH) and of the Swiss Federal Court (Bundesgericht). The work is based on the philosophical principle of legitimacy and develops a method of judicial gap filling out of this principle. It compares the court decisions with this method. Finally, the thesis proposes a legal norm containing methodical instructions for the judges.

Anke Schmidt hat ein vollständiges deutsches und ein französisches juristisches Studium an den Universitäten Potsdam, Paris X-Nanterre und der Humboldt-Universität zu Berlin absolviert. In Frankreich hat sie eine maîtrise en droit erworben. Nach dem Ersten Juristischen Staatsexamen war sie von 2002 bis 2005 als wissenschaftliche Mitarbeiterin an einem Lehrstuhl für deutsches Bürgerliches Recht, Internationales Privatrecht und Rechtsvergleichung bei Prof. Dr. Thomas Kadner Graziano an der Universität Genf tätig. Ihr Referendariat hat sie von 2005 bis 2009 in Berlin abgeleistet. Nach Abschluss Ihrer Promotion arbeitet Anke Schmidt seit 2017 als Referentin im Bundesministerium für Gesundheit.
