Due to the trend towards Europeanization and globalization, the prerequisites for drafting a constitution, for constitutional practice and comparing constitutions have been discussed a great deal by experts and the public in the past years. Winfried Brugger (1950-2010) was an outstanding participant in these discussions. This volume contains approximately 40 essays contributed in his memory by renowned scholars. Divided into five thematic groups, the subjects deal with various aspects of constitutional prerequisites, ranging from philosophy of law, methodology, history, religion, legal procedure, the supranational and international and finally the comparative prerequisites. The authors delve into questions of justice and common welfare and build a thematic bridge from the stability of the law to the significance of food, explain the dark side of law in addition to the idea of man. The subjects range from Rome to the Brazilian constitutional court, from Herder and Moses Mendelsohn to Scalia and Brugger.
