The protection of intellectual property in criminal law has been enhanced considerably under the influence of European legal policies. The close integration with the implementation of protective rights under civil law is reinforced by the close cooperation between the representatives of the injured party and the prosecuting authorities. From a constitutional standpoint, the resulting functionalization of criminal proceedings for civil law purposes has led to considerable problems. However, the blanket criminal law provisions concerned have raised a lot of doubts in the interpretation of the undefined legal terms elsewhere as well. For example, the ambiguous methodology in the area of the theory of errors or in questions of the perpetration of an offence, for instance in the case of indirect infringement of a patent, have proven to be problematic. In the long run, it will be necessary to coordinate this with related branches of criminal law.
