This book offers a comprehensive exploration of contemporary issues in consumer law. Organized by the International Association of Consumer Law (IACL), it delves into the multifaceted challenges and developments in consumer protection across various jurisdictions and sectors. The book was presented at the 18th World Consumer Law Conference in Hamburg. The book begins by addressing the integration of consumer protection within financial services. It provides insights into the Brazilian repayment plan for over-indebted consumers, emphasizing the judiciary's role in safeguarding consumer rights. Additionally, it examines the protection of shareholders and creditors as consumers of corporate responsibility reports, offering a South African perspective on this critical issue. A significant portion of this book is dedicated to the obligations of traders for faulty goods, with a comparative analysis between Ghana and the UK. It also discusses the seller's right to redress in consumer sales within the EU, highlighting missed opportunities in the current legal framework. The book further explores the legal challenges related to the lack of durability in consumer goods, providing a thorough examination of this pressing concern. The importance of an interdisciplinary approach to consumer law is underscored by exploring the intersection of consumer law with competition law, gender studies, and intellectual property. Notably, it discusses the impact of EU Directive 2014/104 on damages actions for infringements of competition law and shares insights from the Argentinian experience on gender and consumer protection. The protection of foreign well-known trademarks in China is also analyzed, offering valuable guidance for international businesses. The role of Online Dispute Resolution (ODR) in enhancing consumer protection is highlighted. The book examines the Ombudsman's role in strengthening ODR for consumers in Indonesia and discusses the challenges of resolving consumer disputes in Brazil. The impact of UNCITRAL technical notes on ODR in electronic commerce is also analyzed, emphasizing the need for efficient and accessible dispute resolution mechanisms. In the digital age, this book addresses the evolving challenges in consumer protection. It examines joint controllership in the digital marketing sector, unresolved issues in EU consumer law regarding blockchain, and the liability of online platforms under EU and Turkish law. The book also discusses the challenges of artificial intelligence in healthcare and the potential role of no-fault insurance, as well as deceptive design practices in digital interfaces. The intersection of consumer protection and sustainability is explored, proposing the extension of consumer protection to pollution victims and providing recommendations for mitigation policies. The empowerment and disempowerment of consumers in the context of sustainability are also examined, highlighting the delicate balance between consumer rights and environmental protection. Emerging issues in consumer law are addressed, such as the concept of contracts for use and the challenges of food law as a new frontier of consumer law. The book also explores the international protection of tourists as consumers, offering a global perspective on consumer rights. This book provides a detailed and insightful analysis of the current challenges and developments in consumer law. It is an essential resource for legal scholars, practitioners, and policymakers seeking to understand and navigate the complex landscape of consumer protection in the modern era.
